1. In fact, the thought of a government of the people, by the people, and for the people had come into being long before. However, the word “people” did not cover people of all walks of life. For example, in the United States in the 1860s, the black people were not included in the realm of the word “people” and not until 1920 did they gain the right to vote. President Ho Chi Minh defined “people” as all the Vietnamese.

He laid special stress on the nature of the Vietnamese Government as the one to guarantee all interests and rights to the people. The construction and innovation of the country also was the people’s duty, and governments from the grassroots to the central levels are elected by the people.

Accordingly, if those elected by the people fail to fulfil their duties as empowered by the people, the people can dismiss them. And the people are who gives the power to the apparatus. The state must exercise power under the law to serve the people. On the other side, the people are entitled to doing anything that the law does not prohibit.

The State of Vietnam also came into being thanks to the efforts of the whole people in the August Revolution in 1945. Then, the cadres were elected by the people. Finance for the operation of the apparatus was from the people. The policies and organizational structure of the state were discussed and constructed by the people, and the operation of the State was placed under the supervision of the people as it is still now.

The state of the people, by the people, and for the people does not work for itself, but for the benefits of the whole people. Ho Chi Minh once said, “The state must by all means do whatever is beneficial to the people and avoid whatever does harm to the people. The cadres from the central to the local levels must work as servants for the people.”

According to Ho Chi Minh, the state bears the nature of the class. However, he never made it absolute. The Party of Vietnam is also the party of the working class, the working people, and the nation, representing and bringing interests to the whole nation. Therefore, he considered the State of Vietnam as the people’s democratic state, formed on the union of the working class and the peasantry led by the working class.

2. The state must ensure the role and effectiveness of the law in all activities of the society. The state and the law are closely related. The law provides a system of conduct for the state and the people regardless of any social classes, helping the state manage the society.

Deeply understanding that relationship, in 1919, Nguyen Ai Quoc, on behalf of the Vietnamese patriots, sent the Versailles Peace Conference a petition. The petition called on the French Government to change the management of the Vietnamese society by decrees to by law. It is obvious that governance by law is more advanced than by decrees. President Ho Chi Minh is the man to make the nation of Vietnam and is also the one to contribute the most to the constitution and legislation of the country.

After 70 years of development, the construction of the state of the people, by the people, and for the people in Vietnam has gained significant results, greatly contributing to the cause of national liberation and construction.

However, there still remain shortcomings in the construction; therefore, to fix them, the state should better grasp and apply Ho Chi Minh thought on the construction of the state of the people, by the people, and for the people. Ho Chi Minh thought has served and will serve as the guideline for the development of the State of Vietnam now and in the future.
