BRIEF INFORMATION ON THE CONTRIBUTION OF DOCTORAL THESIS

Title: “Improvement of the law on the autonomy and self-responsibility of current local governments in Vietnam”

SUMMARY OF THE MAJOR CONCLUSIONS

1. The law on the autonomy and self-responsibility of local authorities, which include all legal norms issued by competent State authorities, is aiming at enabling local governments to make decisions and take responsibility for all public affairs within the limits laid down by the laws; be responsible for carrying out tasks/duties in their localities on the basis of decentralization and authorization by upper level governments. The improvement of legal regulations on the autonomy and self-responsibility of local governments contributes to ensure that decisions of each level of government be made according to the local residents’s demand and benefits and be suitable with conditions and development level of each locality, and contribute to strengthening public administration capacity of authorities from central to local levels.

2. The law of Vietnam has not yet sufficiently empowered local governments so that each local government has the ability to actively solve the problems arising in the locality or decide the local affairs and take responsibility for those decisions before the law. Therefore, it is neccesary to improve the law to enable governments at all levels to have sufficient resources as well as competence regarding finance, organization, human resources or the authority to issue legal documents to carry out tasks assigned by the law. 

3. In order to improve the law on autonomy and self-responsibility of local governments at all levels, it is neccesary to implement the following solutions: (1) improving legal regulations on assignment of missions/duties and powers of all level local governments; (2) improving legal regulations to ensure the autonomy and self-responsibility for finance and budget; (3) improving legal regulations to ensure the autonomy and self-responsibility in apparatus and personnel; (4) improving legal regulations on the authority to issue legal documents; (5) improving legal regulations on other matters to ensure consistency and uniformity of the legal system, in accordance with the fact that Vietnam’s under the unitary State model.
